Introduction
This Return Policy applies to all purchases of products offered for sale through the Online Channels (collectively, the "Products"), including but not limited to fine jewellery and luxury accessories, by FOXY DIAMONDS B.V., together with its affiliates and subsidiaries (collectively, "Foxy Diamonds", "we", "us", or "our").
For the purposes of this Return Policy, "Online Channels" shall include, without limitation, Foxy Diamonds' websites, mobile applications, social media pages, and any other online platforms operated or authorized by Foxy Diamonds.
By placing an "Order" (as defined in the Terms of Sale) with Foxy Diamonds, you agree to be bound by the terms of this Return Policy. This Return Policy is to be read in conjunction with Foxy Diamonds' Terms of Use, Terms of Sale, Shipping Policy, Warranty Policy, Promotion Policy, Privacy Policy and Cookies Policy, all of which form an integral part of your contractual rights and obligations.
Foxy Diamonds reserves the right, at its sole discretion, to update, modify, or amend this Return Policy at any time. Any such changes shall apply only to Orders placed after the effective date of the revised Return Policy. Orders accepted prior to such changes shall remain governed by the Return Policy in effect at the time of acceptance.
If you do not accept this Return Policy in full, you must refrain from placing any Order through the Online Channels.
Nothing in this Return Policy shall limit, restrict, or exclude any rights conferred upon you under mandatory Belgian or EU law. In the event of any inconsistency between this Return Policy and applicable mandatory law, such mandatory law shall prevail.
Statutory Right of Withdrawal and Cooling-Off Period
In accordance with EU Directive 2011/83/EU on Consumer Rights, as implemented in Belgian law, natural persons acting for purposes outside their trade, business, or profession ("Consumers") have the statutory right to withdraw from the Contract (as defined in the Terms of Sale) for Products acquired through Foxy Diamonds' Online Channels within fourteen (14) calendar days from the date on which the Consumer, or a third party indicated by the Consumer other than the carrier, takes physical possession of the Product(s).
Extended Cooling-Off Period
Notwithstanding the statutory period, Foxy Diamonds has elected, at its sole discretion, to extend the Cooling-Off Period to thirty (30) calendar days from the date of delivery of the Product(s) (the "Cooling-Off Period"). During this period, Consumers may exercise their right to cancel the Contract and return the Product(s) in accordance with the procedures and conditions set forth in this Return Policy.
Exercise of the Right of Withdrawal
To validly exercise your statutory right of withdrawal during the Cooling-Off Period, you must contact Foxy Diamonds' customer service team via email provided in the section "Contact Us" to notify us of your decision to cancel the Contract.
Your notice of cancellation must:
- Clearly identify the Order number;
- Specify the Product(s) for which cancellation is requested; and
- Constitute an unequivocal expression of your intention to exercise your rights under the Cooling-Off Period in accordance with applicable Belgian or EU consumer protection law.
Upon receipt of your notification, Foxy Diamonds shall provide you with detailed instructions for the return of the Product(s), including a return label, if applicable. Return labels are not automatically provided with your Order and must be requested from Foxy Diamonds. If a return label is issued, Foxy Diamonds shall cover the cost of return shipment, but you remain responsible for sending the Product(s) strictly in accordance with the instructions provided.
You are solely responsible for ensuring that the Product(s) are securely and appropriately packaged to prevent any damage, loss, or deterioration during transit. Foxy Diamonds shall not be liable for any loss, damage, or deterioration occurring during the return shipment, except to the extent that liability is imposed under mandatory Belgian or EU legislation.
The original IGI or GIA certificate accompanying the Product(s) must be returned with the Product(s) in the same shipment. If the original IGI or GIA certificate is missing, a replacement fee of one hundred (100) EUR will apply.
The return shipment must also include documentation sufficient to identify the original Order, such as the order confirmation, invoice, or order number.
Exclusions to the Right of Withdrawal
In accordance with EU Directive 2011/83/EU on Consumer Rights, as implemented in Belgian law, the statutory right of withdrawal does not apply to the following categories of Products, including, without limitation:
- Personalized, customized, or engraved Products, including items monogrammed, engraved, or otherwise modified at the Consumer's request, whether on the inner or outer surface of the Product.
- Products with non-standard or custom sizes, including Products that deviate significantly from standard sizing specifications.
- Products subject to individual design modifications or bespoke requests, including unique, made-to-order Products.
- Sealed items which are not suitable for return for hygiene or safety reasons once unsealed, in accordance with applicable Belgian or EU legislation.
- Perishable goods or items that have been inseparably combined or mixed with other goods after delivery, such that they cannot be returned without significant alteration, damage, or loss of value.
- Products explicitly specified as non-returnable at the time of purchase.
For all Products falling within these exclusions:
- The statutory right to cancel the Contract or exercise the Cooling-Off Period shall not apply.
- Any remedies, including repair, replacement, or refund, shall be governed exclusively by Foxy Diamonds' Warranty Policy and, where relevant, the Shipping Policy.
- Foxy Diamonds shall have no obligation to accept returns, exchanges, or refunds beyond what is expressly provided under these policies, without prejudice to any mandatory rights under applicable Belgian or EU law.
- Consumers acknowledge that any such remedies are provided solely at Foxy Diamonds' discretion and in accordance with the applicable policies.
Condition of Returned Products
Returned Products pursuant to the statutory right of withdrawal, including during the Cooling-Off Period, must be returned in a condition consistent with applicable Belgian and EU laws. Specifically, returned Products must not show any deterioration in value resulting from use, handling, or alteration beyond what is necessary to inspect the nature, characteristics, and functionality of the Product. Any handling, damage, or alteration exceeding this standard may, at Foxy Diamonds' sole discretion, result in a partial refund, a deduction reflecting diminution in value, or the rejection of the return.
All returned Products must include the original packaging, protective coverings, accessories, documentation, and any promotional items supplied with the Product at the time of delivery.
Foxy Diamonds reserves the right to inspect, verify, and authenticate all returned Products prior to authorising any refund, replacement, or exchange. Such inspection may include, without limitation, verification of authenticity, examination of gemstones, metals, hallmarks, or other identifying features, assessment of physical condition including scratches, dents, wear, or alterations, confirmation of completeness of the Product including all packaging, accessories, and certificates, and verification that the return complies with the instructions provided by Foxy Diamonds. Based on this inspection, Foxy Diamonds may, at its sole discretion, approve the return and issue a full refund, issue a partial refund reflecting any diminution in value, or reject the return entirely.
Consumers are responsible for securely packaging and returning the Product(s) in accordance with Foxy Diamonds' return instructions, including any return label provided. While Foxy Diamonds shall bear the cost of return shipping where a return label is issued, the risk of loss, damage, or deterioration during transit remains with the Consumer, except to the extent that liability arises under mandatory Belgian or EU law or where the Product is returned strictly in accordance with Foxy Diamonds' prescribed procedures.
Refunds
Upon receipt of the returned Product(s) and following satisfactory inspection and verification in accordance with the conditions set forth in this Return Policy, Foxy Diamonds shall issue a refund to the original form of payment. Refunds will generally be processed within seven (7) to fourteen (14) calendar days from the date of receipt of the returned Product(s).
Refunds shall include the purchase price of the Product(s) but shall exclude any delivery charges, taxes, duties, or other fees that are non-refundable under applicable Belgian or EU law.
Foxy Diamonds shall not be liable for any delay in refund processing caused by circumstances beyond its reasonable control, including, without limitation, delays attributable to courier services, customs procedures, force majeure events, or financial institutions.
Interaction with Warranty Policy
Products returned due to defects, faults, or non-conformities covered under the Foxy Diamonds Warranty Policy are expressly excluded from the statutory right of withdrawal under the Cooling-Off Period. Any such returns shall be processed solely in accordance with the procedures and remedies set forth in the Warranty Policy, including, without limitation, repair, replacement, or refund, as applicable.
Consumers acknowledge and agree that the statutory right of withdrawal does not apply to warranty claims, and any remedies or resolutions for Products subject to the Warranty Policy are governed exclusively by the terms and conditions of that policy, without prejudice to any mandatory rights under Belgian or EU law.
Return After the Expiration of the Cooling-Off Period
Returns requested after the expiration of the Cooling-Off Period shall be handled solely at the discretion of Foxy Diamonds and are not covered by the statutory right of withdrawal.
To initiate a return after the expiration of the Cooling-Off Period, you must contact Foxy Diamonds' customer service team via the email provided in the section "Contact Us". Submission of a return request does not create any obligation on the part of Foxy Diamonds to accept the return, and Foxy Diamonds reserves the right, at its sole discretion, to approve or refuse any such return. If Foxy Diamonds agrees to accept the return, you will be provided with detailed instructions for the return shipment, which must be strictly followed.
The cost of return shipment shall be borne by the Consumer. All returned Product(s) must be shipped using an insured method with tracking, and risk of loss or damage during return shipment remains with the Consumer, except to the extent liability is imposed under mandatory Belgian or EU law. Failure to follow the instructions provided by Foxy Diamonds, or to ensure proper packaging, insurance, or tracking, may result in partial or full denial of the return or refund, at Foxy Diamonds' sole discretion.
Exchanges
Foxy Diamonds does not offer exchanges. Any request to exchange a Product will be treated as a return of the original Product and the placement of a new Order, which shall be subject to all applicable provisions of this Return Policy, including, without limitation, the Cooling-Off Period, return procedures, and shipping requirements.
Limitation of Liability
Scope of Liability
Subject to mandatory Belgian and EU law, Foxy Diamonds shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or in connection with the return of Product(s), the exercise of the Cooling-Off Period, or the processing of refunds. Any liability of Foxy Diamonds shall be strictly limited to the remedies expressly provided in this Return Policy and shall not include any compensation for consequential, incidental, or indirect losses.
Return Shipment Risk
Consumers are responsible for ensuring that returned Product(s) are securely packaged, shipped in strict accordance with the instructions provided by Foxy Diamonds, and sent using the designated courier with insurance and tracking where instructed. Risk of loss, damage, or deterioration during return transit remains with the Consumer, except to the extent liability is imposed under mandatory Belgian or EU law.
Inspection and Verification
Refunds or other remedies are contingent upon Foxy Diamonds' inspection, verification, and authentication of returned Product(s). Foxy Diamonds shall not be liable for any delay, reduction, or refusal of a refund resulting from:
- Use, handling, or storage of Product(s) inconsistent with Foxy Diamonds' instructions or ordinary care;
- Missing components, packaging, accessories, or documentation;
- Damage, wear, or alterations not attributable to a manufacturing defect; or
- Non-compliance with the return instructions provided by Foxy Diamonds.
Certificates and Documentation
The original IGI or GIA certificate accompanying the Product(s) must be returned in the same shipment. Any loss or failure to return the certificate is the responsibility of the Consumer. Foxy Diamonds shall not be liable for any delays, costs, or fees arising from missing certificates, including the applicable replacement fee.
Third-Party Services
Foxy Diamonds shall not be liable for any acts, omissions, or failures by third-party logistics providers, carriers, or other service providers engaged for the return shipment, including delays, loss, theft, or damage during transit, except to the extent liability is imposed under mandatory Belgian or EU law.
Force Majeure and Unforeseeable Events
Foxy Diamonds shall not be liable for any delays, failures, or disruptions in processing returns or refunds arising from circumstances beyond its reasonable control, including, without limitation:
- Acts of God, natural disasters, pandemics, strikes, civil unrest, or governmental actions;
- Courier or carrier delays, errors, or failures;
- Customs clearance, import/export, or regulatory procedures;
- Incorrect, incomplete, or misleading information provided by the Consumer; or
- Any other event or circumstance beyond Foxy Diamonds' reasonable control.
Refund Timing
While Foxy Diamonds shall use commercially reasonable efforts to process refunds within the timelines set forth in this Return Policy, it shall not be liable for any loss, damage, or cost resulting from delays outside its reasonable control, including financial institution processing times or delays arising from third-party systems.
Consumer Acknowledgement
By returning Product(s), Consumers acknowledge and agree that they:
- Have read, understood, and accepted the procedures and risks associated with returns as outlined in this Return Policy;
- Accept that refunds, exchanges, or other remedies may be subject to Foxy Diamonds' verification and inspection process; and
- Waive any claim for consequential, incidental, or indirect damages arising from the return of Product(s), except where prohibited by mandatory law.
Reservation of Rights
Foxy Diamonds expressly reserves all rights to:
- Inspect, verify, and authenticate any returned Product(s) prior to authorising any refund, replacement, or exchange;
- Deny a refund or issue a partial refund where Product(s) are incomplete, damaged, altered, or do not comply with the conditions of this Return Policy; and
- Determine, at its sole discretion, the method, timing, and amount of any refund or partial refund.
Foxy Diamonds further reserves the right, at its sole discretion, to update, amend, or modify the limitations of liability set forth herein at any time. Any such changes shall apply only to returns submitted after the effective date of such amendments and shall not reduce, limit, or otherwise impair mandatory consumer rights under Belgian or EU legislation.
